2. Eligibility and Acceptance
By using our website or placing an order, you confirm that you have the legal capacity to enter into a binding agreement with us or that you are using the website with the authorization of a parent or legal guardian where permitted by applicable law.
You agree to provide accurate, current, and complete information when placing an order or otherwise interacting with our website.
If you do not agree to these Terms, you should not use our website or place an order with us.
3. Products and Product Information
We make reasonable efforts to display and describe our products as accurately as possible, including their colours, features, specifications, sizes, and appearance.
However, the appearance of colours and other product details may vary depending on your device, screen settings, photography, lighting, or other factors.
Product availability is subject to change without notice. We reserve the right to discontinue products or limit quantities where reasonably necessary.
Nothing in this section limits any rights you may have where a product is defective, damaged, misdescribed, or otherwise does not conform to applicable consumer protection requirements.
4. Prices and Currency
Product prices are displayed on our website and may change from time to time.
The price applicable to your order is the price displayed at checkout when you submit your order, subject to correction of obvious pricing or technical errors.
We offer free shipping on all Canadian orders. There is no minimum order value required to qualify for free standard shipping.
Any applicable taxes or other charges collected by us will be shown during checkout where applicable.
5. Customs, Duties and Import Taxes
Orders delivered to Canada may be subject to customs duties, import taxes, brokerage fees, or other charges imposed by Canadian authorities or the applicable carrier.
Any customs duties, import taxes, or similar charges that are not collected at checkout are the responsibility of the customer.
These charges are determined by the relevant authorities and are outside the control of The Maple Gents.
This provision is intended to be read together with our Shipping Policy, which contains additional information regarding international fulfillment and delivery to Canada.
6. Placing an Order
When you submit an order through our website, you are offering to purchase the products included in your order subject to these Terms.
After placing an order, you may receive an order confirmation by email. We reserve the right to reject or cancel an order where reasonably necessary, including where:
- A product is unavailable;
- There is an obvious pricing, description, or technical error;
- We are unable to process or verify payment;
- We cannot deliver to the address provided;
- We reasonably suspect fraud, unauthorized activity, or misuse of our website; or
- We are otherwise unable to fulfill the order.
If we cancel an order after payment has been successfully collected, we will refund the amount paid for the cancelled item or order to the original payment method.
7. Payment
Payment must be made using one of the payment methods available at checkout.
Payments may be processed by third-party payment service providers. These providers may process payment and transaction information in accordance with their own terms and privacy practices.
You agree to provide complete and accurate billing and payment information and confirm that you are authorized to use the payment method provided.
We reserve the right to decline or cancel a transaction where we reasonably suspect fraud, unauthorized payment activity, or another legitimate security concern.
8. Shipping Destination
We currently ship orders to addresses within Canada.
Customers are responsible for providing a complete and accurate shipping address at checkout.
If you discover an error in your shipping information, please contact us as soon as possible. We will try to update the information before dispatch, but changes cannot be guaranteed once an order has entered processing or has been shipped.
9. Processing and Delivery Times
Orders are generally processed within 1–3 business days.
After processing, the estimated delivery time is 3–8 business days.
The total estimated timeframe from placing an order to delivery is therefore approximately 4–11 business days.
Business days are Monday through Friday, excluding applicable public holidays.
Delivery times are estimates and are not guaranteed. Delays may occur due to circumstances outside our reasonable control, including carrier disruptions, customs processing, severe weather, public holidays, high-volume periods, or other transportation issues.
For further information, please review our Shipping Policy.
10. Tracking and Delivery
Tracking information is available for shipped orders where provided by the applicable carrier.
Once your order has been dispatched and tracking information becomes available, you can use the tracking details to follow your shipment through our Track Your Order page.
If your order is significantly delayed, appears to be lost in transit, or tracking indicates delivery, but you cannot locate the package, please contact our customer service team so that we can review the situation and assist with the appropriate next steps.
If a shipment is confirmed as lost in transit, we will provide an appropriate resolution in accordance with applicable law and the circumstances of the order.
11. Order Changes and Cancellations
To cancel your order, please contact us at info@themaplegents.com within 1 hour of placing your order. After this period, cancellation may not be possible if processing has started.
Once an order has been processed, it cannot be cancelled. For full details, please see our Cancellation Policy.
12. Returns
We offer a 30-day return period. You can request a return within 30 days from the date your order was delivered, subject to the conditions in our Return and Refund Policy.
To qualify for a standard return, products generally must be returned in their original condition, unworn, unused, and unwashed, with original tags, labels, and packaging where applicable.
All returns must first be registered with our customer service team. Please do not send a return without first contacting us and receiving the appropriate return instructions.
If you ordered the wrong product or size, the item does not fit, you changed your mind, or you otherwise no longer want the product, you are responsible for the return shipping costs.
For complete eligibility requirements and return instructions, please review our Return and Refund Policy.
13. Faulty, Damaged or Incorrect Products
If you receive a product that is faulty, defective, damaged in transit, or different from the product you ordered, please contact our customer service team as soon as possible.
We may ask you to provide your order number, a description of the issue, and photographs showing the product, defect, damage, incorrect item, and/or packaging where relevant.
If an item is confirmed to be faulty, defective, damaged in transit, or incorrect due to an error on our part, you will not be responsible for reasonable return shipping costs where a return is required.
We will provide an appropriate resolution based on the circumstances and applicable consumer protection laws.
14. Refunds
Once a returned item has been received and inspected, we will notify you regarding the status of your refund.
If the return is approved, the refund will be issued to your original payment method.
We aim to process approved refunds within 14 days after receiving the returned item.
After we issue the refund, your bank, card issuer, or payment provider may require additional processing time before the funds appear in your account. This additional processing time is outside our control.
15. Exchanges
We currently do not offer direct exchanges.
If you would like another size, colour, or product, you may return the original item in accordance with our Return and Refund Policy and place a new order for your preferred item.
16. Promotions and Discount Codes
From time to time, we may offer promotional codes, vouchers, or discounts.
Promotions may be subject to additional terms communicated at the time of the offer, including validity periods, eligible products, minimum purchase requirements, or usage limitations.
Unless otherwise stated, promotional codes cannot be exchanged for cash and cannot be applied retrospectively to orders that have already been completed.
17. Acceptable Use
You agree not to misuse our website or use it for unlawful, fraudulent, abusive, or harmful purposes.
You must not:
- Introduce viruses, malware, malicious code, or other harmful technologies;
- Attempt to gain unauthorized access to our website, servers, systems, or databases;
- Interfere with the security, availability, or operation of the website;
- Use automated systems to scrape or extract data from our website without authorization;
- Place fraudulent, false, or unauthorized orders;
- Use the website in violation of applicable laws or regulations; or
- Infringe the intellectual property, privacy, or other legal rights of another person.
We may restrict or terminate access to our website where we reasonably believe these requirements have been violated.
18. Intellectual Property
Unless otherwise stated, the content available through our website, including text, graphics, logos, images, designs, website elements, and other materials, is owned by or licensed to The Maple Gents or its applicable licensors and is protected by applicable intellectual property laws.
You may use our website for personal, non-commercial purposes.
You may not reproduce, distribute, modify, republish, sell, commercially exploit, or otherwise use protected website content without prior authorization, except where permitted by applicable law.
19. Third-Party Services and Links
Our website may use or contain links to services operated by third parties, including payment providers, shipping providers, ecommerce technology providers, or other external websites.
Third-party services may be governed by their own terms and privacy policies. We are not responsible for the content or practices of independent third-party websites or services, except to the extent responsibility cannot be excluded under applicable law.
20. Privacy and Data Protection
Our collection and handling of personal information is described in our Privacy Policy.
Our store is powered by Shopify, and certain personal information may be processed by Shopify and other service providers as necessary to operate our ecommerce services, process orders, provide payments, arrange fulfillment, prevent fraud, and perform related services.
Cookies and similar technologies are used in accordance with our Privacy Policy and applicable consent requirements.
21. Website Availability
We aim to keep our website available and functioning properly, but we do not guarantee that access will always be uninterrupted or error-free.
We may temporarily suspend, restrict, update, or modify the website for maintenance, security, operational, or technical reasons.
You are responsible for ensuring that your device and software are appropriately protected when accessing websites and online services.
22. Limitation of Liability
To the fullest extent permitted by applicable law, The Maple Gents and Nora Ecom Valley will not be liable for indirect, incidental, special, or consequential losses arising from the use of our website or purchase of our products where such liability may lawfully be excluded or limited.
Nothing in these Terms excludes, restricts, or limits liability where doing so would be prohibited by applicable law.
In particular, nothing in these Terms is intended to exclude or restrict mandatory rights or remedies available to consumers under applicable consumer protection laws.
23. Events Outside Our Reasonable Control
We will not be responsible for a delay or failure to perform an obligation where the delay or failure results from circumstances outside our reasonable control.
Such circumstances may include severe weather, natural disasters, carrier disruptions, customs delays, strikes, transportation interruptions, governmental actions, telecommunications failures, or other events that we could not reasonably prevent or control.
Where such an event affects an order, we will make reasonable efforts to communicate relevant information and fulfill our obligations as soon as reasonably possible.
24. Changes to These Terms
We may update these Terms from time to time to reflect changes to our Services, business practices, policies, technology, or applicable legal requirements.
The version of the Terms published on our website at the time you place an order will generally apply to that order, unless a change is required by applicable law.
25. Severability
If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, that provision will be applied to the maximum extent permitted by law, and the remaining provisions will continue to remain in effect.
26. No Waiver
If we do not immediately exercise or enforce a right available to us under these Terms, this does not mean that we waive that right.
27. Governing Law and Consumer Rights
These Terms and any agreements through which we provide our products or Services are governed by the laws of the Netherlands, to the extent permitted by applicable law.
However, because our store serves consumers in Canada, nothing in these Terms is intended to deprive you of mandatory consumer protection rights that apply to you under the laws of your Canadian province or territory or other applicable Canadian law.
If a provision of these Terms conflicts with a mandatory consumer protection requirement that cannot legally be excluded or limited, the mandatory requirement will apply to the extent of that conflict.
